My child needs assistive technology and receives special education services at school. Can I get the AT through the IEP process?
Yes! The IDEA requires schools to ensure that assistive technology devices and services are available to students with disabilities.
If the AT device is necessary for the student to receive a free and appropriate public education (FAPE) then the school must purchase the AT and pay for necessary maintenance.
What if I suspect my child could benefit from AT but I don’t know what type?
You can ask for an evaluation. Once you make this request, the school has 60 days to complete it.
- You will receive a prior written notice explaining the school’s decision to conduct the evaluation or, if the request is denied, why the school denied the evaluation.
- A failure to evaluate a student for AT may amount to a failure to provide FAPE.
- If you disagree with the results of the evaluation, you can ask for an independent educational evaluation or file a due process complaint.
